1. Who we are
Lost Aura Games ("we", "us") is operated by Kohlton Michael Hilbert, an individual (sole proprietor) doing business as Lost Aura Games, located in United States. You can reach us at lostauragames@gmail.com. These Terms of Service ("Terms") apply to the website https://lostauragames.com, the games on it (currently Croak & Dagger, Orbit Hills, MEOWTEOR and the Mythweald Open Beta), player accounts and any in-game purchases (together, the "Service").
By playing our games, creating an account or buying anything from us, you agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, please do not use the Service.
2. Age, parents and guardians
- Anyone may play our games as a guest, without an account.
- You must be at least 13 years old to create an account or make a purchase. Children under 13 must not create an account.
- If you are under 18 (or the age of majority where you live), you may only create an account and buy things with the permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your purchases.
- Parents: purchases need an account, a password and a payment method. Please keep your payment details out of reach of children and contact us if a purchase was made without your permission (see the Refund Policy).
3. Your account
- An account is only needed to buy and keep in-game currency on our server, or to play Mythweald online. Give a real email address you control and keep your password secret. You are responsible for everything done with your account.
- One person per account. You may not sell, trade, share, lend or transfer your account or anything in it.
- Tell us right away at lostauragames@gmail.com if you think someone else is using your account.
- You can stop using the Service at any time and ask us to delete your account (see the Privacy Policy).
4. License to play (a license, not a sale)
We grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to play our games in a web browser for your own non-commercial entertainment. The games, their code, art, music, characters and all virtual items and currency are owned by us (or our licensors) and are licensed, not sold, to you. You may not:
- cheat, use bots, scripts, exploits or modified clients, or tamper with game saves, balances, scores or network requests to get coins, items or leaderboard positions you did not earn;
- attack, overload, probe or interfere with our servers, databases or other players;
- copy, sell, rent, redistribute or reverse engineer the games except where the law expressly allows it;
- use offensive, hateful or impersonating names on the leaderboard or for a Mythweald character (we may remove or rename them);
- harass, threaten, bully, spam or abuse other players in chat, get around the chat filter or a block, or share other people's personal information;
- sell, buy or trade game accounts, characters, gold or items for real money or anything outside the game.
5. Virtual currency and items
Orbit Hills uses "credits" and MEOWTEOR uses "stars" (together, "Coins"). You can earn Coins by playing, and on accounts you can also buy Coins. Croak & Dagger and Mythweald have no purchases of any kind. Mythweald's gold and items are earned only by playing, and are covered by the "no cash value" rules below, except that they can be traded between players inside Mythweald with its trade window and market (see section 12).
- No cash value. Coins and virtual items are a limited license to use a feature of the game. They are not money, not property, not a deposit and not a gift card. They have no cash value and can never be redeemed, refunded or exchanged for real money, goods or anything of value, except where the law requires it.
- Non-transferable. Coins are tied to one account and one game. They cannot be moved between games or accounts, sold, traded or gifted.
- Server balance. While signed in, the balance stored on our server is the official one. We may correct balances that are wrong because of a bug, an error, a refund, a chargeback, fraud or a breach of these Terms.
- Earning limits. To keep the games fair, we limit how many Coins can be earned per run and per day, and how many guest Coins are moved into an account the first time you sign in.
- Guest saves. If you play without an account, your progress and Coins live only in your browser. Clearing browser data, private browsing or changing device can erase them and we cannot restore them.
- Changes. We may change, balance, rename, re-price or retire Coins and items. If we stop offering a game with purchasable Coins, we will give at least 30 days' notice in the game and on this site.
- Final purchases. Purchases of Coins are final and non-refundable, except as required by law or as described in our Refund Policy and the payment provider's policies.
6. Buying Coins
- Purchases are processed by our online reseller Lemon Squeezy, LLC ("Lemon Squeezy"), which is the Merchant of Record for your order. Lemon Squeezy handles the checkout, payment, sales tax / VAT, receipts and payment-related customer service, and its Buyer Terms also apply to your purchase.
- Prices are shown in US dollars before any taxes that apply where you live. Your bank may charge currency conversion fees.
- Coins are delivered to the account you are signed in with, normally within seconds and at the latest within a few minutes after the payment is confirmed. If they have not arrived within an hour, contact us with your order number.
- Immediate delivery and the right of withdrawal (EU/EEA/UK and similar laws). Coins are digital content supplied immediately. At checkout you expressly ask for immediate delivery and acknowledge that you lose your 14-day right of withdrawal once delivery has begun. This does not affect your other statutory rights, for example if the digital content is faulty or not delivered.
- If a payment is refunded or charged back, we remove the matching Coins. If they were already spent, your balance may show a deficit that is paid off by Coins you receive later, and we may restrict or suspend accounts involved in fraudulent chargebacks.
7. Availability and changes to the Service
We are a small studio. We try to keep the games online and working, but we do not promise that the Service will be uninterrupted, error-free or available forever, and we may change, update or remove features or games. We may update these Terms; if a change is material we will post a notice on the site, and the "Last updated" date above will change. Continuing to use the Service after a change means you accept the new Terms.
8. Termination
You may stop using the Service and delete your account at any time. We may suspend or close an account, remove Coins or items, or refuse service if you break these Terms, commit fraud or abuse refunds or chargebacks, if required by law, or to protect players or the Service. When an account is closed, your license ends and unused Coins and items are forfeited without compensation, except where the law requires otherwise. If we close your account without cause, we will refund the unused purchased Coins that you bought in the previous 90 days. Sections 4, 5, 9, 10 and 11 survive termination.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms excludes rights or warranties that cannot be excluded by law, including the statutory rights of consumers in the EU, EEA and UK.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost progress or lost profits, and our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places do not allow these limits, so they may not apply to you. We do not limit liability for death or personal injury caused by negligence, for fraud, or where the law does not allow it.
11. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Kentucky, United States, and applicable US federal law, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in the Commonwealth of Kentucky, and you and we consent to their jurisdiction. If you are a consumer living in the EU, EEA or UK, you also keep the protection of the mandatory laws of your country and may bring a claim in your local courts. Before filing any claim, please email us so we can try to fix the problem informally.
12. Mythweald Open Beta
- Beta. Mythweald is an Open Beta and is provided as is. Features, balance, items and rules may change, and characters, levels, gold, items, market listings and mail may be reset or deleted at any time, without compensation.
- Trades and the market are final. Trades you confirm and items you buy or sell on the Unity of the Trade (including the 1% market tax) are final. We may reverse trades or remove items and gold that came from bugs, exploits, cheating or a breach of these Terms, and we do not restore items lost in a trade you agreed to.
- Chat and conduct. Chat is filtered automatically (profanity and slurs are masked and offensive names are refused), but the filter can miss things and chat is not moderated live. Use the block feature and report players to lostauragames@gmail.com. We may hide messages, rename characters, restrict chat or trading, or suspend accounts that break these Terms.
- Other players. Other players' messages and names are their own; we are not responsible for them, but we will act on reports.
